| MEDIATION and TRAINING What is Mediation? Mediation is a voluntary process that leads to resolving disputes promptly, amicably and at far lower cost in time and money than using the courts. This process is facilitated by an impartial third party, the Mediator. Mediation is a unique legal process by which the parties control the outcome by reaching a convenient mutual agreement. Each party is given the opportunity to express and explore their situation, and their goals, needs, and options are analyzed. An agreement to mediate involves only a promise to negotiate in good faith. The parties are not bound unless a mutual agreement is reached. |

Arbitration involves a trained, qualified third party who, with prior agreement, examines all facts presented by the parties, evaluates them, and as fairly as possible, renders a decision which is binding. Arbitration cases cover a broad spectrum of conflict and disputes. Whenever possible, at the time the appointment is scheduled, the best and most appropriate method for the situation is discussed with the attorneys--and the parties, and together select the more efficient and satisfactory method for their situation. |
