MEDIATION and TRAINING

What is Mediation?

Mediation is a voluntary process that leads to resolving disputes
promptly, amicably and at far lower cost in time and money than using
the courts.  This process is facilitated by an impartial third party, the
Mediator.

Mediation is a unique legal process by which the parties control the
outcome by reaching a convenient mutual agreement.   Each party is
given the opportunity to express and explore their situation, and their
goals, needs, and options are analyzed.  An agreement to mediate
involves only a promise to negotiate in good faith.  The parties are not
bound unless a mutual agreement is reached.
Additional Benefits:

  • We strive  to make the process friendly and conciliatory,

  • Mediation is informal, accessible,  flexible, and in most
cases the session lasts 2 to 3 hours,

  • Mediation is private and confidential, no courtroom or
    public venting of personal problems,

  • Mediation solves the problem and attempts to save the
    relationship,

  • Mediation is held at a conveniently agreed time and location,

  • Bilingual Mediation in Spanish,  is available, and Mediation
with the assistance of trained  interpreters, in most languages,
    could be arranged.

Cristina could enter the dispute at any stage upon agreement by both
parties and assist them and their attorneys in reaching an agreement
acceptable to both sides; therefore avoiding costly litigation and
unnecessary delays.

Cristina brings to the Mediation table understanding and respect for both
parties, becoming accepted and trusted as an even–handed neutral
facilitator.

What is Arbitration?

Arbitration involves a trained, qualified third party who, with
prior agreement, examines all facts presented by the parties,
evaluates them, and as fairly as possible, renders a decision
which is binding.  Arbitration cases cover a broad spectrum
of conflict and disputes.

Whenever possible, at the time the appointment is scheduled, the
best and most appropriate method for the situation is discussed
with the attorneys--and the parties, and together select the more
efficient and satisfactory method for their situation.
